Due Diligence (DD) typically occurs in connection with possible corporate transactions. DD can be carried out in a number of different areas, including patents and trademarks. IP and patent DD consist, among other things, of an analysis of a part or the full patent portfolio with a goal of establishing an overview of the scope, duration and geographical spread of protection of the rights, as well as how resistant the patents are to objections from third parties. Part of the patent DD analysis usually includes a Freedom-to-Operate analysis, which results in a presumption that a product can be marketed without infringing other patents or IP rights.
